In this paper, I engage the debate on Suits’ theory of games by providing a Kantian view of Utopia. I argue that although the Kantian aspects of Suits’ approach are often overlooked in comparison to its Socratic-Platonic aspects, Kant’s ideas play a fundamental role in Suits’ proposal. In particular, Kant’s concept of ‘regulative idea’ is the basis of Suits’ Utopia. I regard Utopia as Suits’ regulative idea on game playing. In doing so, I take Utopia to play a double role (...) in Suits’ theory of games. First, it highlights the primary condition of possibility of game-playing, namely, the lusory attitude. Second, it provides a normative criterion that serves as a critical principle to evaluate instances of game playing and as a counterfactual assumption that makes game playing possible. I provide further support for my Kantian interpretation of Suits’ Utopia by bringing to light the anthropological assumptions upon which Utopia is built. In doing so, I argue that both Suits’ theory of games, in general, and his Utopia, in particular, lay out the conditions of possibility of game playing, not an analysis on the life most worth living. In this paper, we explore the issue of the elimination of sports, or elements of sports, that present a high risk of brain injury. In particular, we critically examine two elements of Angelo Corlett’s and Pam Sailors’ arguments for the prohibition of football and Nicholas Dixon’s claim for the reformation of boxing to eliminate blows to the head based on the empirical assumption of an essential or causal connection between brain injuries incurred in football and the development of a degenerative (...) brain disease known as chronic traumatic encephalopathy ; and John Stuart Mill’s rejection of consensual domination. We present four arguments to contest the validity of Corlett, Dixon’s and Sailor’s positions. Specifically, we argue that certain autonomy-based arguments undermine paternalist arguments for reform; the nature of the goods people pursue in their lives might justify their foregoing future autonomy; Mill’s argument against consensual domination draws on ambiguous and arbitrary distinctions; the lack of consensus and empirical evidence regarding CTE arising from brain injuries in sport underdetermines calls for reform. We conclude that these proposals for reforming or eliminating sports with high risks of brain injuries are not well founded. (shrink)

In this article, we examine scholarly analyses of justice and develop a framework that can help assess the claims from the parties in the Russian state-led doping scandal, including, but not limited to, Russian athletes, non-Russian athletes, the World Anti-Doping Agency, and sport governing bodies. The two key components of this justice framework are pluralism and relationality/contextuality. We argue that a justice framework built upon these elements better captures the nature of justice. We conclude that no party in the Russian (...) state-led doping case has exclusive access to justice. Rather, all the parties have legitimate calls for justice against one another. Thus, the administration of justice will fail to serve justice, in its different meanings, for all parties. (shrink)

Since Sigmund Freud developed and popularized psychoanalysis, this psychological theory has significantly influenced contemporary thinking, particularly in philosophical disciplines focused on understanding human behavior and addressing social problems. Take the examples of political philosophy, race theory, and feminist thought, among many others. However, although sport philosophy qualifies as one such discipline, scholars in this field have given little to no attention to psychoanalysis and psychoanalytical theorists. Remarkably, psychoanalytical notions, especially those of Eric Berne and Norman O. Brown, significantly shaped Bernard (...) Suits’ pioneering thoughts on games. Nevertheless, sport philosophers have largely overlooked the importance of psychoanalysis in Suits’ examinations of games and, more broadly speaking, rarely attempted to apply psychoanalytical concepts to their analyses of sport. In this paper, I explain the psychoanalytical roots of Suits’ theory of games and explore how much of his theory of games is indebted to psychoanalysis. Specifically, I first compare Suits’ analysis of unconscious gameplay to psychoanalytic concepts of repression and neurosis. Subsequently, I explore the alignment between Suits’ views on gameplay and psychoanalytic accounts of play and pleasure. To conclude, I examine the therapeutic and emancipatory character of Suits’ proposal, drawing parallels between his philosophical corpus and critical theorists whose critical analyses of modern society are heavily indebted to Freud. Its sequel, Return of the Grasshopper: Games, Leisure, and the Good Life in the Third Millennium, released in October 2022, enriches scholarly understandings of Suits’ views on games, emphasizing the normative aspects of gameplay and its impact on people’s pursuit of the good life. In this book symposium, world-leading Suits scholars analyze the Suitsian conception of gameplay and its relevance to his views on (...) Utopia outlined in the sequel, covering a wide range of topics. Filip Kobiela explores counterfactual situations in Suits’ oeuvre. Christopher Bartel and Gwen Bradford scrutinize the ethical nature and ramifications of Suits’ claim that life is an unconscious game. R. Scott Kretchmar and John S. Russell present thoughtful critiques of Suits’ musing on Utopia. William J. Morgan’s contribution integrates contemporary work studies to illuminate Suits’ utopia. This paper addresses the possibility of robots engaging in sports. Recently, several movies like Ex-Machina, Chappi, and Transcendence challenge the spectator to think of the consequences of creating artificial intelligences. Although we refer to athletes who have outstanding sporting performances as machines, for example, in cycling people say ‘the cyclist looked like a machine with wheels,’ the potential participation of such AI in sport has not been addressed. For our argument’s sake, we will assume that the creation of human-like robots (...) who will mirror human athletes’ behavior in the playing field will be possible. Recent advances in cybernetics and robotics point in this way. As argued in the literature on philosophy of mind, the fact that intelligent robots seem to be doing something does not imply they are actually doing it. Several authors, such as William J. Morgan, John S. Russell and R. Scott Kretchmar, have claimed that the limits between the diverse normative theories of sport need to be revisited. Most of these works are philosophically grounded in Anglo-American philosophical approaches. For instance, William J. Morgan’s proposal is mainly based on Richard Rorty’s philosophy. But he also discusses with some European philosophers like Jürgen Habermas. However, Habermas’ central ideas are rejected by Morgan. The purpose of this paper is to analyse (...) In this paper, linguistic-analytic philosophy has been identified as the dominant methodology in the philosophy of sport. The hermeneutics of sport is contrasted with linguistic-analytic philosophy by analyzing Heidegger’s view of Truth. In doing so, two views of philosophy are compared: ontology or description. Sport hermeneutics’ task has to do with description. Hermeneutical explanations of sport attempt to describe the facticity of sport. Such a facticity is formed by three moments: embodiment, capabilities, and tradition. They are not components of sport (...) that can be identified as essential components but rather, they are identifiable only for analytic purposes. These three above-mentioned elements cannot be identified as elements, because they are intrinsically intertwined forming a unitary network of meaning. The task of sport hermeneutics is to describe the different relationships that compose such a network of meaning. Hermeneutics is the exploration of the process of textual interpretation. As such, it has long been recognised as an important component within the humanities and social sciences, whether one deals with actual texts or with other the products of meaningful human activity, including social actions and utterances. Here, we offer a brief overview of the contribution that hermeneutics might make to the philosophy of sport. If sports and sporting events are seen to be the results of meaningful human interactions, then (...) they are meaningful phenomena that lend themselves to interpretation. It can thus be argued that a hermeneutics of sport is a valid and important discipline, worthy of consideration and development. We offer a review of the nature and history of hermeneutics in general, briefly exploring the place of key figures such as Schleiermacher, Heidegger, Gadamer and Riceour, as well as key concepts such as that of the hermeneutic circle. In addition, we suggest the importance of a hermeneutics of suspicion, grounded in the work of Marx, Freud and Nietzsche. In the second part of our introduction, we briefly comment on each of the papers that comprise the current volume, and that reflect the diversity of approaches that a hermeneutics of sport might embrace. Organized youth sport has become a prominent activity in Western societies, one around which myriad families structure their daily lives. Despite its popularity, or rather because of it, youth sport is besotted with complex problems. One distinctive set of problems pertains to children’s opportunities to benefit from engagement in sport. Such problems require a reflection on the conditions of justice. The goal of this paper is to explore ethical guidelines to make youth sport more just. The paper begins by characterizing (...) childhood, youth, and youth sport. Then, it articulates considerations of justice in youth sport. Together, these sections provide a basis to formulate the general features of a just youth sport. What emerges is a vision of youth sport that the adults involved in it should emphasize and implement if their young charges, and youth sport, are to flourish, as well as a novel approach to formulating and justifying normative criteria to make youth sport more just. Given current studies in moral psychology and following recent cases of wrong behaviour occurred in elite sporting events—i.e. the racist chants scandals in the English Premier League or the events following Mourinho’s poke in the eye scandal—, I shall analyze the extent to which supporters’ brain makeup is biasing them to behave in an “unfair way”. Yet, this paper is not just a work on descriptive ethics, but a normative ethics work. Therefore, once I have developed the “psycho-biological account of (...) sports supporters”, I shall explore whether or not a more virtuous account of sports supporting can be drawn. To conclude, I shall utilize such neuroethical analysis of the sport supporter in order to propose some policies or strategies that can help us to promote a “healthy” and virtuous behaviour among fans. The main goal of this paper is to argue that Anglo-American philosophy and Continental philosophy should work together within the arena of the philosophy of sport. To do so, the concept “communicative community”, which is found in Habermas’ and Apel’s discursive ethics, will be analyzed and applied to sports. As several authors, such as Raúl Sebastian Solanes, Robert L. Simon and William J. Morgan, have done this task before, I will critically analyze their proposals. The Concussion in Sport Group guidelines have successfully brought the attention of brain injuries to the global medical and sport research communities, and has significantly impacted brain injury-related practices and rules of international sport. Despite being the global repository of state-of-the-art science, diagnostic tools and guides to clinical practice, the ensuing consensus statements remain the object of ethical and sociocultural criticism. The purpose of this paper is to bring to bear a broad range of multidisciplinary challenges to the processes and (...) products of sport-related concussion movement. We identify lacunae in scientific research and clinical guidance in relation to age, disability, gender and race. We also identify, through multidisciplinary and interdisciplinary analysis, a range of ethical problems resulting from conflicts of interest, processes of attributing expertise in sport-related concussion, unjustifiably narrow methodological control and insufficient athlete engagement in research and policy development. We argue that the sport and exercise medicine community need to augment the existing research and practice foci to understand these problems more holistically and, in turn, provide guidance and recommendations that help sport clinicians better care for brain-injured athletes. In this article, I revise the normative account of sport that I proposed in ‘William J. Morgan’s “conventionalist internalism” approach. Furthering internalism? A critical hermeneutical response.’ I first present Habermas’ discursive ethics, placing emphasis on his interpretation of the relationship between moral (Kantian) and ethical (Hegelian/hermeneutical) principles. Then, I provide a reformulation of my account by both drawing on Habermas and going beyond him—as I go beyond Habermas, I will refer to the account as ‘discourse-ethics based.’ To further explore the (...) normative potential of the account, I connect its main tenets to the three main normative theories of sport (formalism, broad internalism, and deep conventionalism) and illustrate it with examples from anti-doping governance. After two years of discussions and revisions, the World Anti-Doping Agency (WADA) published the 2021 World Anti-Doping Code on June 16, 2020. Among the most significant additions to this iteration of the Code was the inclusion of new categories of athletes subject to differential treatment by WADA, including the “protected person” category. In this paper, we examine the recent case of figure skater Kamila Valeryevna Valieva, the first athlete given differential treatment due to her being categorized as a “protected person.” (...) We apply a relational justice framework to the case to provide a nuanced, descriptive analysis of the case generally, and the application of the “protected person” category in particular.We first describe details of the athlete, her performances and anti-doping rule violation, and the “protected person” category, to provide context. We then describe and analyze the relations between several institutional actors, principally WADA and the International Court for the Arbitration of Sport (CAS), the athlete and her team, and other figure skating athletes at the Beijing Winter Olympic Games. To do so, we use two concepts of justice, conservative and ideal, and their component parts, entitlement, desert, and need.Our description and analyses demonstrate that (1) WADA’s notions of justice are essentially conservative, while CAS acted toward more ideal notions, creating a fundamental disagreement in what was owed and to whom. We show (2) that CAS’ decision may have nonetheless caused harm to the athlete, raising questions about the efficacy and capability of the “protected person” category. Finally, (3) our analyses show the influence that notions of justice necessarily have these actors shape each other, thus change the sporting institutions and activities themselves. (shrink)

This is the reason why fair play is not just something related to athletes but to supporters as well. To conclude, I shall sketch the boundaries of fair-play-based supporting behaviour in order to propose some policies or strategies that can help us to promote a ?healthy? and virtuous behaviour among fans. In this article, I investigate whether states should regulate energy-drink marketing practices targeting gamers. Energy drinks are high-sugar, high-caffeine, non-alcoholic beverages that allegedly improve energy, stamina, cognitive performance, and concentration. First, I define what “gamer” means and identify the market agents that play a crucial role in the gaming community, including the energy-drink industry. In doing so, I analyze energy-drink marketing practices and explore calls for regulating them. Second, I draw parallels between regulation of energy-drink marketing and marketing of products (...) such as video games and comics with explicit violent and sexual content, tobacco, alcohol, and food high in fat, sugar, and salt. Third, I examine arguments to justify regulation of energy-drink marketing practices that target gamers. Lastly, I formulate an autonomy-based argument for regulating such marketing practices. Uno de los debates más recientes referentes a la innovación tecnológica entre los especialistas en ética es aquel sobre la mejora humana, el cual ha surgido a raíz de la posibilidad de modificar los límites de la naturaleza humana usando el poder de la ciencia. Muchos filósofos nos han avisado del peligro de modificar técnicamente nuestra naturaleza humana. Otros, por contra, defienden que no existe diferencia moral relevante alguna entre las nuevas técnicas biomédicas de mejora y las tecnologías aceptadas como (...) habituales por los seres humanos. Este artículo pretende examinar críticamente tal argumento. El fin de este análisis crítico será doble, primero, mostrar que los autores que defienden esta posición poseen visiones sesgadas y prejuiciosas de la realidad y, segundo, que es necesario establecer una definición más precisa y acotada del término “mejora”. La finalidad de este artículo es triple. Primero, las secciones 1 y 2 expondrán la estructura del argumento de Jürgen Habermas respecto a las tecnologías de mejora humana. Para ello, éste será descompuesto en tres partes, que son sus pilares básicos: a) los sujetos diseñados no pueden auto-concebirse a sí mismos como autores únicos de sus vidas; b) la distinción kantiana entre objetos y personas se desvanece como consecuencia del modo en que los sujetos modificados experiencian su cuerpo; c) la (...) relación entre los padres y su descendencia se vuelve asimétrica, de modo que es contraria a las normas de la acción comunicativa. Segundo, en la sección 3, que es concebida como un diálogo entre Habermas y sus críticos, se presentarán algunas objeciones teóricas a su argumento. Tercero, la sección 4 analizará la validez de los argumentos habermasianos y afirmará firmemente que la posición de Habermas arroja luz sobre el modo correcto de analizar las tecnologías de mejora humana desde un punto de vista moral. A saber, en función de la influencia que tienen sobre el modo en que los sujetos se auto-conciben como seres autónomos y responsables.The aim of this paper is threefold. First, the structure of Jürgen Habermas’ argument on human enhancement technologies shall be exposed in sections 1 and 2. In order to do so, this paper shall discompose Habermas’ argument in the following three parts, which will be taken to be its central pillars: a) designed people cannot self-conceive themselves as the sole authors of their lives; b) the Kantian distinction between objects and persons falls apart due to the way in which modified people experience their bodies; c) the relationship between parents and their modified offspring turns into an asymmetric one, so it is contrary to the rules of communicative action. Secondly, several objections to Habermas’ claims shall be exposed in section 3, which is mainly conceived as a dialogue between Habermas and his critics. Thirdly, section 4 shall analyse the validity ofHabermas’ claims. It shall firmly argue that his position sheds light on the right way to analyse human enhancement technologies from a moral point of view. (shrink)

We argue that an unqualified use of the term solidarity in public health is not only equivocal but problematic toward the ends of public health. The term may be deployed normatively by public health advocates to strengthen the bonds among public health practitioners and refer to an ideal society in which the importance of interdependence among members ought to be acknowledged throughout the polity. We propose an important distinction between partisan solidarity and societal solidarity. Because any moralized belief in a (...) vision of a broad societal solidarity will be a contested political ideal, political reality would limit solidarity based on such a vision to partisan solidarity. An idealized vision of societal solidarity is simply not politically feasible in pluralistic, liberal, democratic societies. However, although societal solidarity is unlikely with respect to any particular policy, it might be hoped for with respect to constitutional procedures that provide boundaries for the agon of the political process. We suggest that moralizing assertions of a solidaristic ideal in a pluralistic society might be counterproductive to generating the political support necessary for public health per se and establishing legitimate public health policy. A pragmatic political approach would be for public health advocates to generate sufficient strong political support for those public health policies that are most amenable to the political and social realities of a time and place. The ethics of using genetic engineering to enhance athletic performance has been a recurring topic in the sport philosophy and bioethics literature. In this article, we analyze the ethics of cloning horses for polo competition. In doing so, we critically examine the arguments most commonly advanced to justify this practice. In the process, we raise concerns about cloning horses for polo competition, centering on normative aspects pertaining to sport ethics usually neglected by defenders of cloning. In particular, we focus on (...) how this practice could have a detrimental impact on the central skills of polo, and how it unjustly creates an uneven playing field.
